High Court - US Giant, Tom James attempts to restrain Max Potter from doing the job he has "fallen in love with" - Law360 reports

US based tailoring giant Tom James Company has launched legal action against an ex-employee Max Potter, alleging breaches of restrictive covenants and confidentiality. Tom James are seeking to enforce a non-compete clause until June 2026. The case is currently before the High Court at The Royal Courts of Justice, London. Constantine Law acts for Mr Potter.


Mr Potter told Law360 on Friday 17 October that the case is about "if Tom James succeeds, it sets a dangerous precedent whereby large American corporations can control their U.K. subsidiaries and British employees after they've left their employment. All I want is a chance to continue in the trade that I've found purpose and passion in."


Constantine Law's Managing Partner, John Hayes added that "a total restriction on trade is unenforceable and a non-compete must be very careful justified in each case," - further highlighting the conflict between a big US corporate culture and the working patterns and legal framework for individuals in the UK.
