Why banning non-compete clauses won’t help UK businesses - John Hayes writes for Personnel Today

Writing for Personnel Today, Managing Partner John Hayes explains why Andy Burnham’s ostensibly pro-business proposal to scrap non-compete clauses will do little to address the underlying issues facing UK businesses:

“The evidential reasoning behind this change is inconclusive: many businesses do not want this change at all. After all, innovators typically spend millions of pounds in sweat equity developing new business, and they do not want people they’ve worked with in developing that new business to walk out the door free of non-competes and with no remedy against them. That, in effect, is the government’s proposal.”

John argues that the proposed ban risks overlooking how employers protect investment, confidential information and valuable commercial relationships.
