- General and Serious Crime | Constantine Law
General and Serious Crime We are a team of highly experienced criminal law specialists, advising and representing individuals and corporations throughout criminal investigations and prosecutions. We understand that the impact of a criminal allegation can be significant and overwhelming and can impact every part of your personal and professional life. When facing an allegation, it is essential to seek accurate, realistic advice at the earliest opportunity in order to have the greatest influence on the outcome of the investigation. We advise clients before, during and after police interview, and in those cases where charges are brought, throughout prosecution. Our approach from the outset is sensitive, strategic and tactically astute, with consideration to both the short and long-term impact of the case on all aspects of your life, career and reputation. When clients come to us pre-charge, we are often able to enter into communications with the police and/or Crown Prosecution service by way of Pre-Charge Engagement. This means we can make representations in favour of avoiding prosecution and expedite reaching the best possible outcome for you. We are experts in dealing with the police and Crown Prosecution Service and have experience of acting for clients facing a vast range of criminal offences. These include sexual offences, controlling and coercive behaviour, violence offences, public order offences, drugs offences, road traffic offences and health and safety offences. Whilst many of our cases are discontinued pre-charge, in the event of a prosecution we assemble a strong defence team to represent you at court. We work proactively and with steely determination, ensuring no stone is left unturned, to achieve the best possible outcome. Our clients are often professionals who face serious implications as a result of investigation. We are specialists at navigating regulatory investigations, regulatory disclosure obligations, internal investigations and DBS check implications alongside a criminal investigation. Where matters overlap with other areas of law – such as employment, immigration or family law – we work with lawyers who specialise in those areas to ensure that your advice is comprehensive and well thought-through. Our team works tirelessly and with the utmost discretion to provide you with clear, pragmatic advice, to limit the impact of investigation, and to provide the highest standard of client service. Funding We can discuss the funding options, the proposed scope of work and budget with you. Depending on the situation, you should check whether you have any legal expenses insurance (for example under professional indemnity, Directors’ & Officers’ or household insurance policies) or consider whether a third party, such as an employer, will contribute to your legal fees (eg under an indemnity). - Applications based on EU law | Constantine Law
Applications based on EU law The EU Settlement Scheme (EUSS) remains open to EEA & Swiss nationals who established residence in the UK before 2021, giving them the ability to regularise or extend their status in the UK, and move towards settlement. Under changes in July 2025, those living in the UK with pre-settled status may now qualify to move to settled status, even where they have broken continuity of residence in the UK since 2021. The law governing the EUSS is complex. In cases where an application is treated late without a reasonable excuse, there may be no statutory right of appeal. We are experts in EUSS applications, including out of time applications, applications for durable partners and rights of appeal. Recent Cases Some recent matters our partners have handled include: Complex application involving absence from the UK of more than 5 ½ years, successfully argued on appeal that this was allowed as an absence from the UK for an important reason For an individual stopped at the UK border and given removal directions, successfully cancelling removal directions and obtaining pre-settled status on a path to settlement, as the durable partner of an EEA national Our Services Eligibility assessment – we understand your immigration, study and employment history, and identify how you meet each requirement of the rules Preparation – we work with you to prepare a portfolio of evidence to establish, to a forensic standard, how the requirements of the rules are met Execution – we submit your application ensuring it meets every requirement, and act as your representative to the Home Office Other immigration services For Businesses Sponsor licence applications Skilled Worker and Global Business Mobility visas Sponsorship compliance Business travel Right to work checks and illegal working For Individuals Applications for family members Global talent, Investors and Entrepreneurs Settlement British citizenship and ancestry Applications based on EU law Human rights applications Appeals Case Studies See examples of successful case studies here . The right to respect for family and private life (Article 8) or the prohibition on inhuman and degrading treatment, punishment or torture (Article 3) may be engaged by a decision to remove someone from the UK, or to refuse them entry. Our partners are experienced in preparing and presenting human rights-based applications, and requests for exercise of discretion outside of the rules. Our Services Strategic assessment – we closely analyse the legal position, and provide accurate advice on the chances of success Preparation – we prepare a forensic, robust and legally sound case, including obtaining witness statements and expert reports where needed Execution – we handle your application, including preparing full written representations, to maximise the chances of success Decision – where needed, we advise on options for ongoing appeal rights.
