The Employment Rights Act 2025 will result in:
Day one right to statutory sick pay - removal of the sickness waiting days and lower earnings limit for statutory sick pay from April 2026;
Reduction of the unfair dismissal qualifying period from 2 years to 6 months’ service from January 2027 – employees with 6 months service will have the right not to be unfairly dismissed;
Removal of the unfair dismissal cap on compensation from January 2027 – unfair dismissal compensation will no longer be capped at 1 year’s pay; and
Increase in the time limit to bring claims from 3 to 6 months less one day – employees will have longer to bring their claims at the ET.
These changes mean that unmanaged sick leave and performance issues, if not tackled proactively, could have the potential to be hugely costly and disruptive. Over the coming months, sick leave, recruitment and performance management will become more and more critical in managing the new risks imposed by the ERA.
